Sedona AZ (August 22, 2016) – The following is a letter to the SedonaEye.com editor:

VOCA to use HOA funds for golf course improvements – NOT what the bylaws intend.

Get ready for the reserves to be depleted to pay for golf course improvements. Then get ready for to be forced to vote for an increase in assessments. The board meeting is Wednesday, August 24. Fill the room, protest, do what you can if you are against this major change in spending.

FYI: The past president, Hanna, is now on the finance committee. The golf course got a “poor” financial opinion from the reserve study. Seems like the old board put in place a trick to get the homeowners to pay for the problem and the new board is going along with it. How to do you like financially supporting a restaurant, tennis courts, park AND golf course? Hoamco gets a base rate of about $17,000 PER month to fine homeowners. It is not revealed how much more they get from fees and fines. Spending, Spending, Spending….

VOCA’s Common Area

With the guidance of outside legal counsel, the Board has directed that compliance with the VOCA Master Declaration and By-Laws requires that there be a single VOCA capital reserve account.

The VOCA capital reserve account funds the long term replacement, upkeep, and improvement of VOCA’s “common areas” and assets. “Common area” in the Master Declaration and By-Laws includes real property, improvements on the real property, golf course, community center, and community facilities.  The Master Declaration also requires that the assessments paid by the Members are be used for construction, maintenance, and improvement of the common areas as association facilities.

When read with the Master Declaration and By-Laws, it is clear that the By-Law provision that “The payment of the debts, expenses and any other expenditures of the golf course department shall be made solely from golf course cash flow” refers to operational expenditures and not the use of capital reserves; which capital reserves are to be used for support of all VOCA common areas.  At the open August 24 Board Meeting at 3 PM, under new business the Common Area and Capital Reserves will be discussed.

    There appears to have been a behind the scenes decision to consult an attorney to find a way to use HOA funds to pay for the golf course improvements. Who, when? While the master declaration states the association must maintain the common land, and the golf course is common land, the bylaws state HOW that maintenance is to be paid for: From the golf course profits. There is no conflict. If you bought a home in VOCA and read the bylaws, you were assured the golf course would pay for itself. Now with some trickery, your HOA reserves are in question about that.

    The County has placed numerous white “sign” marks on the roads within Sedona Golf Resort. The County has informed HOAMCO that square sign posts will replace round posts, which are not crash worthy. The County will replace the round posts with square posts within the next few weeks.

    Anytime it seems when you give a group of people power over others, very few can handle that in a responsible manner. Have seen it time and again where these boards just go off in their own direction and could care less what the home owners want. Went against a board years ago that was getting kick backs from everyone they hired. I was told to back off or else and thru the process of trying to get control of the board looked over my back many times.

    @Glenn Shannon sorry to hear this happens also in the village. People need to grow up and remove all conflicts of interests. Like the chamber and Steve Senger they are in a big money grab for monies that should be used on infrastructure. Instead we are paying for their ads.

    Where has all the formal policies and procedures gone? It appears that nobody cares as long as they get theirs.

    Larry you’re right and it seems since they can hire an attorney with the associations money so they have the upper hand. If anyone wants to challenge them they would have to hire an attorney at their own expense and that is a great barrier to the board being challenged.
