Smart Meter Opt Out for Health and Privacy Concerns

Smart Meter that caught on fire after installation

Smart Meter that caught on fire after installation

Sedona AZ (February 1, 2013)Sedona, Arizona resident Nancy Baer, in a Letter to the SedonaEye.com Editor provides the following Smart Meter information and update:

For City of Sedona City Council meetings referenced below, visit www.SedonaAZ.gov.

I am writing this information so that you may make an informed decision regarding ‘smart’ meters. Several Sedona residents and I have been appearing before the Sedona City Council during its “public comment” period, in order to fully inform the council about the dangers and harm of ‘smart’ meters.

In addition to the many emails we have sent to them, over the past year and half, the Sedona City Council should be well informed to make a decision, or continue doing research on their own.

Now is the time to send your notice to APS because the Arizona Corporation Commission is getting ready to approve APS‘opt-out’ plan.

There are financial consequences facing residents if they have NOT opted out previously.

Those residents and visitors with medical implants (pace makers, insulin pumps, etc.) cannot tolerate being around microwave frequencies, and it is harmful and dangerous to all, but especially to our kids and pregnant women.

For everyone’s health, safety, security and privacy, I believe we should all ‘opt-out’ as there is no way to contain all of the electromagnetic and radio frequencies to protect ourselves and our loved ones:

Appearance and public comment during City of Sedona Council Meeting:

05:02 – 06:57 Nancy Baer Financial Advantages for City to Intervene with Arizona Corporation Commission

07:22 – 11:25 Monnie Ramsell introduces video of California resident appearing before a California city council about her experience with “opt-out” (there is no federal mandate requiring these devices).

11:40 – 14:12 Elaine Brown *NOTE: The frequency range is at least 1200 feet http://sedonaaz.swagit.com/play/01222013-718 . As stated by Curtis Bennett, Chief Science Officer, Interprovincial Journeyman Electrician (Red Seal), Building Construction Engineering Technologist, “The FCC declaring safety is only addressing the meter as an end use device, the rest of the wireless circuit; routers, relays, etc.. were not accounted for or included in the FCC’s calculations.” (Bennett providing expert witness testimony, Brady, Texas.)

You will be affected by your neighbors’ smart meter. Think of it in a wired application, if you asked me to wire a meter to your house from a pole or junction box, we would pull a set of wires to your home or a set to everyone’s home. Oncor, the utility in Texas said their Smart Meter Routers cover 5 square miles so they can communicate with every building in those 5 sq miles. Oncor said their collectors which are another part of the wireless network cover an average of 125 sq. miles so they can communicate with every device within that area. The meters are the end device, buildings are being radiated whether you have a meter or not. That is why they are dangerous, we aren’t supposed to radiate everything for wireless communication.”

WHAT YOU CAN DO?

If you have already opted out with APS, a blue tag should be on your analog meter. If you do have one, it is not necessary to write again.

Residents can opt out.

Commercial properties please do so also.

APS had formerly said it would not allow commercial opt-out, but we believe it’s worth trying to do so. Just be sure you do so writing and send it via certified/return receipt mail.

In Arizona, address opt out letters to:

NOTICE OF NO CONSENT TO TRESPASS AND SURVEILLANCE, NOTICE OF LIABILITY

Dear APS and all agents, officers, employees, contractors and interested parties,

If you intend to install a “Smart Meter” or any activity monitoring device at the above address, you and all other parties are hereby denied consent for installation and use of all such devices on the above property. Installation and use of any activity monitoring device (AKA “smart meter”) is hereby refused and prohibited. Informed consent is legally required for installation of any surveillance device and any device that will collect and transmit private and personal data to undisclosed and unauthorized parties for undisclosed and unauthorized purposes. Authorization for sharing of personal and private information may only be given by the originator (me!) and subject of that information (me!). That authorization is hereby denied and refused with regard to the above property and all its occupants.

So-called “Smart Meters” violate the law and cause endangerment to residents by the following factors:

1. They individually identify electrical devices inside the home and record when they are operated causing invasion of privacy.

2. They monitor household activity and occupancy in violation of rights and domestic security.

3. They transmit wireless signals which may be intercepted by unauthorized and unknown parties. Those signals can be used to monitor behavior and occupancy and they can be used by criminals to aid criminal activity against the occupants.

4. Data about occupant’s daily habits and activities are collected, recorded and stored in permanent databases which are accessed by parties not authorized or invited to know and share that private data by those who’s activities were recorded.

5. Those with access to the so-called “Smart Meter” databases can review a permanent history of household activities complete with calendar and time-of-day metrics to gain a highly invasive and detailed view of the lives of the occupants.

6. Those databases may be shared with, or fall into the hands of criminals, blackmailers, corrupt law enforcement, private hackers of wireless transmissions, power company employees, and other unidentified parties who may act against the interests of the occupants under metered surveillance.

7. So-called “Smart Meters” are, by definition, surveillance devices which violate Federal and State wiretapping laws by recording and storing databases of private and personal activities and behaviors without the consent or knowledge of those people who are monitored.

8. It is possible for example, with analysis of certain so-called “Smart Meter” data, for unauthorized and distant parties to determine medical conditions, sexual activities, physical locations of persons within the home, vacancy patterns and personal information and habits of the occupants.

9. Your company has not adequately disclosed the particular recording and transmission capabilities of the smart meter, or the extent of the data that will be recorded, stored and shared, or the purposes to which the data will and will not be put.

10. Electromagnetic and Radio Frequency energy contamination from so-called “Smart Meters” exceeds allowable safe and healthful limits for domestic environments as determined by the W.H.O. and others.

11. Your legal easement to my property stops at the meter. Your easement does not include my house’s wiring which I bought and paid for myself and is my property, not yours. Be clear on this: My house’s wiring is my own and you do not have my permission or my consent to use my house’s wiring to send any sort of radio frequency along it for any purpose whatever. You cannot use my wiring for surveillance purposes.

I forbid, refuse and deny consent of any installation and use of any monitoring, eavesdropping, and surveillance devices on my property, my place of residence and my place of occupancy. That applies to and includes so-called “Smart Meters” and activity monitoring devices of any and all kinds. Any attempt to install any such device directed at me, other occupants, my property or residence will constitute trespass, stalking, wiretapping and unlawful surveillance and endangerment of health and safety — all prohibited and punishable by law through criminal and civil complaints. All persons, government agencies and private organizations responsible for installing or operating monitoring devices directed at or recording my activities, which I have not specifically authorized in writing, will be fully liable for any violations, intrusions, harm or negative consequences caused or made possible by those devices whether those negative consequences are justified by “law” or not..

This is legal notice. After this delivery the liabilities listed above may not be denied or avoided by parties named and implied in this notice. Civil Servant immunities and protections do not apply to the installation of so-called “Smart Meters” due to the criminal violations they represent.

Notice to principal is notice to agent and notice to agent is notice to principal. All rights reserved.

Sincerely,

  1. “Naperville armed police assist forced Smart Meter deployment- Two mothers arrested – Posted on January 23, 2013 by admin
Posted in Facebook by Dianne Knight
(ILLINOIS) From Naperville Smart Meter Awareness (NSMA):

Two Naperville mothers were arrested today in conjunction with the forced installation of smart meters. NSMA President, Kim Bendis and Board Member, Jen Stahl were arrested today during a forced installation at Jen’s home.

Details are still pending but Kim was witnessing the event from Jen’s property and was video taping. Three officers shoved her against a tree, pried her camera from her hands, and cuffed her. Both Jen and Kim were taken into police custody sometime in the 2:00 hour CST.

Kim is a mother of 3 school aged children. Jen has 2 school aged children and a toddler at home. All children are safe and are being taken care of by family or friends.

This is an extraordinary tragedy as there is still a pending federal lawsuit and the issue of smart meters has not been decided in Naperville. This demonstrates the lengths to which the city officials have been willing to go to force residents into compliance.

Sources close to the group say that during a closed door council session there was discussion of the strategy the city would use this week to obtain 100% compliance on installations. Residents have been told the city is willing to use whatever means necessary.”
