Phoenix Attorney suspended after using Trust Account for Investor Scheme

Sedona AZ –  The Presiding Disciplinary Judge of the Arizona Supreme Court along with a Disciplinary Hearing Panel ordered that Phoenix attorney Rodrick S. Carter be suspended for six-months and one day after he provided client trust account access to his half-brother for an investor-related scheme.

Carter knowingly allowed his half-brother to use his law office name, phone number, email address, and trust account to assist him with financial transactions. His half-brother earned fees by arranging bridge loans and/or funding of projects by joining borrowers and/or lenders with other lenders. Carter was directly involved in funding at least one such project.

During the investigation, Carter argued that his negligence was due to his lack of understanding of the rules governing trust accounts. However, the State Bar found that he knowingly and intentionally perpetuated a scheme designed to convince investors to deposit funds into his trust account. Carter allowed the trust account activity to continue until the State Bar became involved.

Rodrick S. Carter’s six-month and one day suspension was ordered effective on March 7, 2019. He was also ordered to pay for the costs and expenses incurred by the State Bar of Arizona.
