ADEQ Slaps Band Aids on Septic Systems

Fait accompli is a thing accomplished and presumably irreversible.

Sedona AZ (September 25, 2013)The following is a letter to the SedonaEye.com editor:

Viewing Arizona’s current residential onsite rules governing the design, installation, operation, maintenance and sale of any residential “septic” system based on those rules approved and authorized in 2001 through an ADEQ lens, one might likely conclude fait accompli as the revisions of 2005 were simply colorful band-aids acceptable to ADEQ mgt/staff – camouflaging blemishes while burying all substantive changes posed by interlopers – “outsiders” – those labeled as whistle blowers … troublemakers … rabble-rousers.

Fast forward to late 2013 and this once vaunted fait accompli is seen as precarious – resting upon a foundation increasingly exposed as anchored in quick-sand… the fabled cornerstones of the 2001 “rule” sold to GRRC and Arizona citizens as – absolutes – rules utilized and enforced “state-wide” … predicated on verifiable evidence … adjudicated by competent knowledgeable regulators (state/county) played on a level playing field has proven fragile and fatally deceptive.

Atop the hierarchical regulatory pyramid ADEQ is, today, in 2013, a mere shell of its former glory reduced today to existing on mere $crap$ the result of financial action$ taken by our state legislature and anyone with a modicum of intelligence realizes the emperor (ADEQ) wears no clothes … commanding little or no respect from the governed – “public” – and at best grudging respect, actually grudging consent, from county regulators the result of legal state delegation compliance agreements.

There are fascinating circumstance which affect the composition, complexion, efficacy of ADEQ since 2001, including but not limited to, a state economy resting on “build it, they will come” housing boom followed immediately by a collapsing the result of a manipulated mortgage foreclosure debacle … a national economic collapse entwined in an international economic collapse … a duplicitous bank$ter reality … and an Arizona citizenry unwilling to be taxed to pay for public health and environmental services.

There is an apparent widely held belief in Arizona that if we refuse to acknowledge a problem, or issue, or situation … that magically … it goes away … ceases to be … which appears enmeshed in the supposition that “I/you/me” (individual) is NOT accountable or responsible … but “they” (point and wag finger) are … this is especially true as it relates to all rules affecting Arizona residential “septic” systems and its users/owners.

As a result owners/users of Arizona “septic” systems are indifferent about the care and use of the “septic” system they utilize each and every day. While legally the laws enacted hold them technically accountable, inasmuch as their voice and their participation was not authentically permitted, it is understandable they feel no obligation to submit to any enforcement or compliance without representation.

And yet curiously ADEQ and its OWAC are actively engaged in promulgating rules and regulation revisions to be submitted to GRRC whenever our Arizona Governor lifts her moratorium on any new rules … which frankly by statue will be needed in 2014 if ADEQ does NOT choose to be “sunset” in 2015.

In 2001 & 2005, America and Arizona generally adhered to a paradigm wherein “we” acknowledged the alleged compulsory authority/power of the “state” … a paradigm which in 2013 finds increased “pushback” and confrontation on many fronts.

America’s seemingly compliant attitude has taken a change in direction wherein Americans are no longer willing to “blindly” accept pronouncements from the “state” (the man … government regulators … public officials) as authentically true … valid … acceptable … to be unconditionally obeyed … to wit the scenario surrounding Syria sheds light on an emerging paradigm where heretofore automatic agreement and compliance is no longer routine and questions abound.

Though not in the spotlight Arizona citizens increasingly are asking of government more direct questions coupled with an unwillingness to accept the prototypical MO “do it” because we represent government and force. Tragically many representing government have had their duplicitous, immoral, illegal, deceitful actions exposed and made public … as a result the level of confidence of Americans/Arizonans in their government pummeled and has all but vanished.

Yet in Arizona there remains an unsustainable belief in ADEQ hierarchy and thought to be successfully proselytized into its residential “septic” onsite waste water advisory committee (OWAC) that authentic collaboration and participation with the “public” is not necessary and ADEQ and their delegated confederates hold power over the “public” to do as we say … or else… suffer the consequences … increasingly the “public” is taking the or else route recognizing ADEQ and county regulators are understaffed, ill supported, essentially impotent.

Arizona onsite residential “septic” rules are … fiat accompli … a thing accomplished and presumably irreversible … though likely not in the manner visualized by ADEQ or OWAC … it would be wise for ADEQ/OWAC to contemplate as noted by Japanese Admiral Yamamoto after attacking Pearl Harbor said … “I fear all we have done it to awaken a great, sleeping giant”.
