City Takes Proactive Approach Regarding Short Term Rentals

Sedona AZ (September 22, 2016)With the passing of Senate Bill (SB) 1350, which now prohibits cities and towns from banning the use of single family residences for short term vacation rentals, the city of Sedona’s Community Development Department encourages those interested in renting their property as a short term rental to contact the Community Development Department to discuss the state regulation and city policies the property owner will need to follow.

Since 1995, the rental of single family homes for periods of less than 30 days has been prohibited within the Sedona city limits. However, during the 2016 state legislative session, SB 1350 was introduced with the intent of streamlining the collection and distribution of transaction privilege taxes for online booking agencies like Airbnb and Vacation Rentals by Owner (VRBO) that market short term vacation rental properties. As the bill progressed, an amendment was offered by Senator Debbie Lesko that would prevent cities and towns from having local ordinances that don’t allow the use of single-family residences for short term vacation rentals.

Arizona State FlagOn May 12, 2016, Arizona Governor Doug Ducey signed SB 1350 into law, making it Arizona Revised Statutes (A.R.S) 9-500.39, which will go into effect December 31, 2016. Thus, because the city’s ban on short term rentals is no longer valid, the city is developing policies around the licensing, registration of an emergency contact, collection of taxes, etc. on properties permitted to operate under the provisions of A.R.S. 9-500.39.

However, something that is important for residents to know is what constitutes as a short term rental. It is defined as an individually or collectively owned single-family home or up-to-four unit home, a condominium or cooperative/timeshare. For example, these are not allowed to be short term rentals:

  • Accessory Dwelling Units (ADUs) on file with the city of Sedona, which have full kitchens, and must be rented for 90 days or more
  • Guest houses which don’t include full kitchens
  • Apartments, unless properly zoned for lodging use
  • Any of the above which are illegally constructed and unpermitted through the city of Sedona.

“We want to be proactive and make sure residents understand the ins and outs of how this law affects our community. We are developing policies around this law to ensure compatibility, safety of our residents and the collection of revenue,” said Warren Campbell, assistant director of community development, city of Sedona.

Those who are considering renting their property within the city of Sedona as a short term rental, or less than 30 days, are encouraged to contact the Community Development Department at 102 Roadrunner Drive or via telephone at 928-282-1154 to discuss the state regulation and city policies by which the property will need to be compliant with.

In short, “stay tuned, and don’t presume,” said Campbell.

    Bring in more money and funnel it to special interest. Take public funds and of course, do not invest in city infrastructure.

    It is not rocket science. Don’t spend more than you take in. Create instead of take. Pay all the bills and with what is left over invest. Invest in Sedona’s future. Build. Here you have a lot of takers. Run the city negative and then take more from the people. Here you have some old has been retirees that have never run a municipality. City Council. Stop, think, and create an infrastructure that has sustainability. This city is always working from behind and thinking of other ways to bleed more revenue from the people.

    The city manager should manage. He receives a huge salary in excess of 150 thousand dollars, plus benefits. He is paid to basically keep his mouth shut. So the takers can keep on taking. A ponzi scheme. The people are sick of it. Sedona is a mirror image of what is wrong with our nation. The people are angry and so are the citizens of Sedona.

    Since Sedona businesses within the city limits are required to have business licenses, shouldn’t that alone give them entitlement to be listed in a legitimately owned and operated City of Sedona Visitors Center? See how simple this conglomerated can of worms could be fixed? All businesses, including city based lodging, would be fairly represented without coercion to join a special interest club, namely a Chamber of Commerce that serves regionally.

    Of course S. Moriarty had to run for a second term. She accomplished approval for alcohol to be served on government property, including the annual Wine Fest which she started. She also assisted in contriving for the city to pay Red Earth Theatre to use the Garland Teen Center, mentioned by Sharlett, and which can also legitimately serve booze.

    But still dangling is city-managed garbage control. Now maybe, just maybe, once she sews up that deal to further facilitate her beloved Sedona Recycles (of which she also initiated) she might think about retiring before she shrinks into oblivion behind her dais. Now this isn’t to imply or indicate in any way Sedona Recycles isn’t a benefit to the community. However, it should not become the financial responsible of residents to contribute financially to personal whims by imposing monthly bills on us.

    Oh oh, not so fast. We still have the matter of affordable housing, another great unknown. That surely will surface to the top of the agenda with short-term rentals on the horizon. So it’s even possible the second term might extend to yet a third in order to fulfill the dream of a row of those cute little houses now available, also to be paid for with public funds.

    However, the grandiose ideas of Mayor M. and her team cheerleaders far exceed the scope of responsibility of incorporated Sedona. Sound familiar? And are you sick of hearing it? Then change your policies and stick to the tasks at hand. Translated: Health, Safety, and Welfare of the residents and businesses located within Sedona City Limits. And that doesn’t include managing every aspect of our lives, including but not limited to which garbage hauler we hire. Nor does it include financial hand-outs of Sedona public funds (taxes) to every Tom, Dick & Harry non-profit that annually line up at City Hall for their “fair share?” Does that sound familiar as well?

    Special events that drive business from the commercial businesses like hotels, shopping center, restaurants, bars also drive sales tax from the city and state.

    Red Earth Theater doesn’t even pay for the space. The city is paying for them to underbid the in-city businesses for entertainment, food and alcohol. While they do NOT contribute at all. The same old performers can get paid more there as Red Earth operates for FREE and still charges entry fees. The best paid businesses are paid by the taxpayers like the chamber, film fest, and red earth.

    @Adeelah agreed they have stolen the City of Sedona and made it their own sovereign city. They do not behave like a city within a state.

    Special rules and PAYMENT for their buddies and pals with no checks and balances. No city operates like this gifting millions of dollars year after year with no return on investments. Disfunctional.

When I lived on Maui I organized the largest motorcycle run on the island which was also the largest single day collection of Toys For Tots on the island year after year. I got no government $. In fact I had to pay the government for cops to control intersections. I also had to buy run insurance indemnifying the County of Maui for any mishap that might occur on “their” roads. Those expenses were huge but I was able to meet them because I had true community support. Businesses and members of Street Bikers United Hawaii donated both money and high ticket raffle items. The raffle tickets also bought participants a banquet at the run’s end. If an event has real community support it should not need government hand-outs.

Are you aware that as of July 2015 the population of Chandler was 260,828 and Sedona’s continues to drop, the last count down from 11,000 to around 10,000. May I suggest you read the information in the editorial previously cited in another comment which quite significantly places Sedona in the appropriate category, in particular with the anticipation of implementation of short term/vacation rentals.

    What is your rationale in comparing Sedona to metropolitan cities? Or are you not aware the original theme of the community plan stressed the importance of maintaining a small town atmosphere. Nothing being presented or implemented since you and others have taken control even comes close to serving that once important endeavor.

    Have you heard of the light bulb being on but nobody is at home? How about an elevator that doesn’t access the top floor? These questions need to be addressed by the seven people seated in those seats in the council chambers in addition to city staff that is responsible for making prudent recommendations to said council members.

    Why does this incorporated city think it’s OK to play big brother to the entire Verde Valley? Translated: All the money they dole out to a regional chamber of commerce and the ongoing financial contributions to non-profits as the list grows becoming too long to mention all of them. Oh sure – old news. Well, don’t they think we citizens living within legitimate Sedona City Limits grow tired of their overstepping, most recently to take control of how we manage the collection of our own garbage and recycling?

    And now these same people clearly do not believe in practicing what they preach as they harp and gripe about following state laws that aren’t to their liking? In addition to the inconvenience of the state now making short term vacation rentals legal throughout the state, they are equally as upset about the approval of SB 1487 which, under specified terms, will allow the investigation of cities and towns that might be violating laws of the state.

    In the case of Sedona should a special investigation take place, it could mean the state withholding the distribution of state shared funds amounting to over two million dollars but at the same time, City of Sedona doles out far more than that amount to referenced regional chamber of commerce to advertise and promote their members.

    And if counties, cities, and towns were abiding by State Laws & Statutes they would have nothing to worry about and no objections to SB 1487, would they?

    So what’s the big deal?

    If Sedona has been following this rule then there is nothing for them to worry about and no need for anyone to break into sweat. However, if that is NOT the case, then, of course, there would be the illogical reason to spew “Draconian” and other nonsense. The truth shall out:

    “The enumerated powers listed in the Constitution should check the federal government’s power and all other issues and concerns are left up to the States (10th Amendment). Unlike the state, the cities, towns and counties are political subdivisions of the state. They are not sovereign jurisdictions themselves. They were organized under the state constitution to allow government to be closer to the people. Their constitutional duties are for transportation, public safety and good governing principles for order and peace. These political subdivisions were not intended to thwart state law and act as independent and sovereign entities.”

    It would be a surprise if all attorneys, or at least most, aren’t aware of this really very elementary principal unless perhaps it’s been overlooked by dismissive abuse.

    We should note that Chandler with a population 25 times that of Sedona provides $30,000 to support events. Also note that distribution of funds is controlled by a citizen volunteers and not through direct participation by Council.

    Perhaps we should follow the Chandler model both in process and the amount of the awards.

The ongoing atrocities in this small city of 10,000 continue to multiply like jack rabbits and it’s way overdue for the State of Arizona to implement a law that will rightfully pull in the reins and restore order in counties, cities, and towns.     Although SB 1350—a controversial law that prohibits cities and counties across Arizona from restricting short-term vacation rentals—will not go into effect until January 1, 2017, small cities like Sedona are already coping with its detrimental impacts. By essentially wresting planning and zoning powers from local governments, SB 1350 significantly reduces the ability of municipalities to control the expansion of their tourism industries in light of the best interests of their citizens.

    The need to balance tourism against quality of life for residents is particularly important in Sedona, which faces unique challenges stemming from the high volume of annual visitors in relation to the city’s small size. In recognition of these challenges, the City of Sedona had previously banned short-term vacation rentals, which are defined as rentals of residential properties for less than 30 days. However, SB 1350 now renders this ban obsolete.

    Representing over $500 million in revenue each year, tourism is undeniably crucial for Sedona’s livelihood. Yet for the benefit of residents and visitors alike, the city must preserve the small-town atmosphere and striking natural beauty that have established its status as one of the leading destinations in the Southwest. Therefore, the growth of Sedona’s tourism industry must be accompanied by regulations designed to minimize traffic congestion, address limited parking availability, conserve resources, and reduce the risk that residents will be subjected to nuisances within their neighborhoods. As the citizens of Sedona are beginning to realize, SB 1350 threatens to disrupt this delicate balance by potentially adding hundreds of new rooms to the short-term rental market.

    In addition to facilitating a drastic influx of visitors, SB 1350 will exacerbate a housing shortage in Sedona. A study conducted by Pennsylvania State University on Airbnb—the popular home-sharing platform that facilitates many short-term rentals of residential properties—found that nearly 40 percent of the company’s revenue was attributable to multi-unit operators who rented their homes full-time, as if they were hotels. Tempted by the prospect of renting their homes on a short-term basis at higher nightly rates, many property owners in the Sedona area are terminating their long-term tenants’ leases. This is already causing rental and real estate prices to skyrocket, leading to mounting stress on Sedona’s economy. There are approximately 500 job openings in the city, and local businesses fear that SB 1350 will make it increasingly difficult for them to find employees due to the insufficient housing available for residents.

    For these reasons, the City of Sedona has vehemently opposed SB 1350 and is currently considering alternative ways to control rentals, such as through licensing requirements and tax collection. The City Council is reviewing a proposed ordinance that will more clearly define the requirements that the city may impose on short-term rentals. For example, the ordinance states that homeowners who rent out their properties will be required to file their contact information with the city and obtain city business licenses and state transaction privilege tax (TPT) licenses. However, platforms like Airbnb typically handle the TPT and other tax collection for their hosts, so this requirement only applies to homeowners who rent their properties on their own. The proposed ordinance aims to return a scintilla of power to the city in terms of regulating the short-term rental market, while clarifying what may be expected of homeowners who wish to rent.

    Local governments have a far better understanding of the needs of their citizens and visitors than does the distant state government, and SB 1350 deprives them of the freedom to do what is best for their communities. In the months leading up to the effective date of SB 1350, the law is already wreaking havoc on Sedona residents and businesses, which are facing rapid inflation of real estate prices, dwindling housing availability, and a surge in tourism that may be greater than the city’s infrastructure is equipped to handle. Unless this law is overturned, Sedona and many other cities throughout the state will have to attempt to control their rental markets and tourism industries through meager mechanisms like those contained in Sedona’s proposed ordinance.

    First of all, any long-time reader at the Eye is well aware that Steve Segner isn’t capable of writing this comment. Second of all, I would bet that Owens-Harkey in Phoenix did write it. And, thirdly, this is merely a propaganda piece for the lodging industry who wants to use its influence with the Council to stop fair competition in its marketplace. Consider this sentence…”This is already causing rental and real estate prices to skyrocket, leading to mounting stress on Sedona’s economy.” How do rising real estate prices cause stress on Sedona’s economy considering Sedona’s real estate market has been in a steep recession for at least the last two years? One last thing must be said to whomever wrote this propaganda piece in behalf of Steve Segner…if the Council attempts to circumvent SB1350, it will most assuredly will run afoul of SB 1487, not to mention that the consequences of a deliberate attempt to circumvent SB1350 will be draconian when the punitive measures of SB1487 are levied against our little city of 9,000! I think it best that our City Council stay out of this fracas since to do otherwise will be to maliciously attempt to legislate interference with free enterprise. Are you listening Madam Mayor?

    Thank you to the State of Arizona for passing two State laws that help control our cities and towns. Passing SB 1350 will increase revenues for the city, state, and residents. It will increase jobs which we need in the Verde Valley. BTW-By paying everyone that asks for money Sedona City you HAVE killed the economy. Paid for things you have no business paying for. CC you have hurt the health welfare and safety of the incorporated city.
    And a elated jubilant Thank you for passing SB1487 which stops our cities and towns from making up laws forcing them to work under the laws governed by the State. Just as it should be. Those stealing money and making Sedona a communist city are the only ones complaining.
    Rejoice people you now have the state to help you. For those LLL that have hijacked the city having them fiance your ads and pay your business expenses, Sedona is not a sovereign city. Now it is time for you to payback every penny you have stolen.

    Miracles do happen. Check out the extremely well-written comment from Steve Segner 10/10. Maybe because it’s on behalf of the Lodging Council it was seen fit to add a masterful articulated touch which ultimately does make some sense.

    However, even without additional vacation rentals as will be provided by implementation of SB 1350, Mr. Segner and his cohorts of both Lodging Council and Chamber of Commerce have already ruined Sedona. Of course that would never have occurred without benefit of cooperation from two past city councils and selected Sedona staff members who continue to produce predetermined results of specified assignments. Next on agenda? City control of our garbage.

    Had the C of C and Lodging Council not been so greedy they might have taken a good chunk of the multi-million dollar contract with the city to provide city-wide amenities such as suggested in the “the law as written” instead of mish-mash advertising that hasn’t been evidenced to attract anything more than day-trippers and unmanageable traffic. And there is absolutely no proof the advertising dollars have amounted to anything other than that. Taking undue credit for an upswing in the national economy after the recession has no merit.

    Maybe those being represented by the special interests of the members of the regional Chamber of Commerce might finally get the message. Sedona Council Members do not have authority to overstep state statutes, in many instances causing a loss of revenue in the collection of both city sales and bed taxes. That is proven every time a Chamber member outside city limits accommodates tourists by renting hotel rooms or selling merchandise that does not collect that source of revenue. If those guests do venture into incorporated Sedona allegedly to shop they represent nothing more than adding to traffic as day-trippers. Period.

    Please State Legislators, one or more, open up an investigation into this rigged rip-off extending beyond Sedona City Limits and averts the following quote taken from “the law as written:”

    “Their constitutional duties are for transportation, public safety and good governing principles for order and peace. These political subdivisions were not intended to thwart state law and act as independent and sovereign entities.”

    “Item f: AB 2164 Approval of a Special Event Liquor License for a Democrats of the Red Rocks event scheduled for Tuesday, November 8, 2016, located at the Hub, 525 Posse Ground Road, Sedona, AZ.”

    This city pays $50,000 to Red Earth Theatre annually to use CITY OWNED PROPERTY and will now approve a liquor-license on the evening of probably the most contentious national election in history to benefit the Democratic Party? Let us hear all of you anti Tea Party whiners complain about that. How about allowing the Republicans the use of Council Chambers at City Hall equal opportunity, liquor license and all? What about the Independent voters?

    Heretofore DARR (Democrats of the Red Rocks) have always rented commercial properties for their events and held their meetings in local restaurants, thereby contributing fairly to city sales tax in addition to patronizing local businesses.

    And for the record, the status of my voter registration card is noted as “Other.” Translated: Not affiliated as Democratic, Republican, or Independent.
