The City of Sedona is seeking applicants for the position of City Attorney.

The City Attorney performs legal work and serves as general counsel to the City of Sedona and as chief legal advisor to the City Council, City departments, and City boards, committees, and commissions. Additionally, this position directs all civil and criminal legal work and reviews and considers all municipal activities.The City Attorney should have extensive knowledge of Arizona law, the ability to supervise the departmental staff, and the understanding of general municipality, State, and Federal laws. THE POSITION

The City Attorney must have solid ethics and integrity, excellent communication skills, and sound managerial experience. Additionally s/he will have excellent interpersonal, public relations, and customer service skills, and have the ability to build and maintain positive working relationships with elected officials, City staff, and the general public. In addition, the City Attorney must have the ability to prepare and deliver effective and clear presentations.

The City Attorney’s office serves the City and the citizens in Civil (Internal) and Prosecution (External). In regards to Civil, the City Attorney’s Office is the attorney and adviser to the Mayor, City Council, City Manager, staff, boards, committees, and commissions. The City Attorney’s office also works to protect and minimize the City’s liability both proactively and when claims and/or lawsuits are filed. Furthermore, the City Attorney’s Office prosecutes all misdemeanor crimes committed within the City limits and filed in the Sedona Magistrate Court. Also, the City Attorney’s office ensures that statutory rights of the victims of crimes are protected.

The City Attorney is responsible for review and revisions of all contracts, agreements, ordinances and other legally binding documents to be entered into by the City. Additionally, this position receives and processes all claims against the City as well as notifies the City insurer of all such claims and handle insurance coverage issues and questions.

ESSENTIAL JOB FUNCTIONS

1. Supervise the City Prosecutor who is responsible for prosecution of misdemeanor cases before the Sedona Magistrate Court, initiating/responding to appeals or special actions.
2. Review all contracts, agreements and other legally binding documents to be entered into by the City; recommend necessary changes, additions, deletions, and or corrections and provide legal opinions to the City Council and City Departments concerning such documents.
3. Advise City departments and personnel concerning legal issues generally, as well as public records, employment, and other matters specifically related to the operations of the department. As requested, conduct training sessions with the City Departments regarding new laws, Open Meeting procedures, public record and conflict-of-interest issues, and other matters that concern compliance with local, state and federal laws.
4. Receive and process all claims against the City; notify the City insurer of all such claims and handle insurance coverage issues and questions.
5. Review and respond to City staff requests for civil legal advice review and respond to City Council or City Manager request for legal advice or services.
6. Provide legal advice concerning personnel matters, disputes and grievances to department heads and personnel managers.
7. Supervise and coordinate the provision of legal services to the City by outside counsel.
8. Study new legislation and case law pertinent to the City; brief City staff and officials concerning the same.
9. Review proposed ordinances and revisions to ordinances; provide legal opinions concerning the propriety, legality, and constitutionality of such ordinances or revisions.
10. Assist department heads in establishing departmental policies by applying legal principles and procedures; recommend changes in policies and procedures in order to meet legal requirements.
11. Review City Council and other committee and commission agendas to insure compliance with Open Meeting laws. Review Council agenda bills and associated documents that are included in informational packets for each meeting.
12. Advise City Clerk on legal issues and procedures relating to elections.
13. Present cases in behalf of the City before the Personnel Board in employment proceedings; conduct workshops for City staff and officials on pertinent legal issues.
14. Respond to complaints and inquiries by the media and the public concerning the City’s legal procedures and position in pending legal matters.
15. Research and draft resolutions, ordinances, contracts and agreements.
16. Make all supervisory decisions regarding the City legal department, including hiring and supervision of staff members, and conducting performance evaluations.
17. Attend City Council, Planning & Zoning Commission and Board of Adjustment meetings as well as other meetings of City committees, boards and commissions.
18. Represent the City in civil appellate matters in state and federal courts.
19. Oversee the preparation of annual department budget.

The appointment will be based on best fit, competency, education, training, and experience. Applicants must possess a Juris Doctorate of Law degree or equivalent and current membership in the State Bar of Arizona. For civil and municipal experience, applicants must have a minimum of five years of experience in the area of public practice experience, preferably in the area of municipal law and land-use law or the equivalent thereto. For criminal experience, applicants should have familiarity with general principals of criminal law and prosecution or any equivalent combination of education and experience that provides the required skills and abilities for the position.

The compensation for the successful candidate is negotiable, depending upon experience, qualifications and professional achievements.

    The city is very generous with our money. Why does a city attorney need city paid life insurance and a car allowance?

    Then there is 100% paid health insurance.

    Has the city made actually living in Sedona so unattractive that they need to offer these perks? Wait, the city of Sedona does not require employees to live in Sedona.

    I’m inclined to agree with Jess. And can we stop the stupid remarks about living and working in Sedona? Please. I lived in a midwestern city and it took longer to go to the mall in my town than it takes to drive to Cottonwood. I didn’t move closer to be near anything but my family and in a house we could afford. Americans drive cars whether it’s two minutes away or two hours. We don’t care about driving and it’s cheap to do.

    Why does city council think we’d live in Sedona if we could? We can, we don’t want. We have kids and we prefer Flagstaff, and no money would entice us to live in your tourist town again. The weather is better and the scenery is as good.
