Phoenix Attorney Disbarred for Stealing Client Funds

State Bar of Arizona logoSedona AZ (October 17, 2013) – The Arizona Supreme Court issued an order disbarring attorney Daniel T. McCarthy of Phoenix, Arizona. The three-member hearing panel led by the Disciplinary Judge (PDJ) of the Arizona Supreme Court ordered that Daniel T. McCarthy be disbarred from the practice of law, effective October 8, 2013.

In count one, McCarthy was found to have kept over $12,000 in bodily injury damages belonging to his clients. The hearing panel determined that McCarthy stole his clients’ money and failed to accurately account for other trust account funds. He was already serving an interim suspension effective April 22, 2013, for the same misconduct.

In count two, McCarthy exposed another client to over $13,000 in damages and sanctions due to his multiple ethics violations.

McCarthy failed to appear in, or defend against, the formal proceedings initiated by the State Bar, which resulted in the PDJ entering a default against him. McCarthy also failed to appear at his aggravation/mitigation hearing intended to determine sanctions for his misconduct. The hearing panel concluded that disbarment was appropriate.

In addition to the disbarment, McCarthy was ordered to pay restitution totaling $25,365.92 to three clients and $2,634.87 to the State Bar of Arizona for costs and expenses incurred during its investigation.
