Arizona Attorney Michael R. Golder Disbarred

State Bar of Arizona logoSedona AZ (July 27, 2016) – Attorney Michael R. Golder of Tempe, Arizona, was disbarred from the State Bar of Arizona after admitting to allegations of misconduct.

On July 7, 2016, a Supreme Court Hearing Panel heard oral arguments where the State Bar of Arizona requested disbarment for Golder. He had failed to participate in a court-ordered settlement conference and failed to appear for a prehearing conference during disciplinary proceedings. On July 20, 2016, the Panel rendered its decision to disbar Golder from the practice of law.

While representing clients in a personal injury case, Golder filed a complaint with the court, but failed to serve it, which led to its dismissal. He did not notify his clients.

In a separate case, Golder failed to file a response to an insurance company’s motion for summary judgment. His failure resulted in the dismissal of his client’s medical malpractice case where a $37,500 settlement had already been negotiated. He did not notify his client of the dismissal.

scales of justice courtDuring Golder’s deposition in the disciplinary proceeding, he indicated that substance abuse affected his ability to represent his clients. He added that he consumed cocaine the night prior to his deposition.

Golder’s disbarment was effective on July 20, 2016. He was ordered to pay all costs incurred by the State Bar of Arizona and the Office of the Presiding Disciplinary Judge. He has appealed the disbarment with the Arizona Supreme Court.

    This matter came for hearing before the Hearing Panel, which rendered its decision on July 20, 2016. No appeal has been filed and the time for appeal has passed.

    Now Therefore, IT IS ORDERED Respondent, MICHAEL R. GOLDER, Bar No. 011497, is disbarred from the State Bar of Arizona and his name is stricken from the roll of lawyers effective July 20, 2016, as set forth in the Decision and Order Imposing Sanctions filed on July 20, 2016. Mr. Golder is no longer entitled to the rights and privileges of a lawyer but remains subject to the jurisdiction of the Court.

    IT IS FURTHER ORDERED Mr. Golder shall immediately comply with the requirements relating to notification of clients and others, and provide and/or file all notices and affidavits required by Rule 72, Ariz. R. Sup. Ct.

    IT IS FURTHER ORDERED granting Judgment to the State Bar of Arizona for costs in the amount of $4,133.68 with interest as provided by law. There are no costs or expenses incurred by the disciplinary clerk and/or Presiding Disciplinary Judge’s Office in connection with these disciplinary proceedings.
