ADEQ and OWAC Questioned About Onsite Septic Rules

Sedona AZ (February 6, 2014) – The following SedonaEye.com letter to the editor is from Paul Miller of Phoenix, Arizona:

I DID NO HARM ……The Richard St. Clair Septic Rule……?

More than 4 months have passed since the circumstances surrounding the action of (current sitting) OWAC member Richard St. Clair was sanctioned by ADEQ and OWAC members; allowing Richard St. Clair to remove and replace the septic tank on his property in Maricopa County without notice or any permit or any oversight by any environmental regulatory body, city, county, state.

· Via certified USPO request has been made to Maricopa County Environmental Health to go on the record on this issue which to date remains unanswered.

· Via internet email a formal on the record position has been requested from ADEQ which to date remains unanswered.

· Via internet email a formal position has been requested from OWAC, to which the reply was provided by Chairman Garrett that Mr. St. Clair reputedly contacted Maricopa County and therefore OWAC passes the buck.

· Via internet email all OWAC were provided a position paper which to date no current OWAC member chose to respond.

· Via internet email information was provide to Maricopa County Environmental Service as well as to Maricopa County Supervisor Andy Kunasek which to date there has been no official response for the record.

Allow me to re-state:

1) no official position from ADEQ …

2) no official position from Maricopa County …

3) no official position from Maricopa Board of Supervisors …

4) pass the buck position from OWAC.

Allow me to go on the record as a citizen of Arizona and member of the public upon whom ADEQ/OWAC choose to exercise and bring to bear the full weight of all current “onsite” rules on “septic” sanctioned by GRRC in 2005:

1) Be advised you cannot have it both ways … either rules apply to everyone or they apply to no one.

2) ADEQ and OWAC need to authentically live by the mantra voted upon and routinely championed that onsite rules “protect public health and the environment” or they do not. 

3) By its silence ADEQ and its OWAC endorse the action of Richard St. Clair thereby sanctioning that anyone/everyone and anywhere in Arizona can remove and replace any septic tank without need to notice or obtain permit or oversight by any regulatory agency, city, county or state.

This is not an issue the public will allow to go gently and quietly into the night.
